fan not spinning down in standby

as per title i cant get the fan to spin down when in standby

ive got pwm set to low ish

and fan off in standy to yes

any help?

The fan will remain active when a recording is going on, or when the box is streaming to any device.
Not sure if the fan will only stop after the HDD fell asleep (that is in standby after the set idle time has passed).

the fan definitely always stays on, i let about 1 hour lapse and it was still blazing away,

any suggestion?

settings i have:

fanOFF instby: yes
pwm value: 200
check period: 5 secs
